Kristian Finfrock Racks Up New Six-Figure Dispute

Kristian Finfrock (CRD #: 5421676), a broker registered with Kalos Capital, is facing a six-figure investment dispute, according to his BrokerCheck record, accessed on February 14, 2022.

On December 14, 2021, an investor alleged that Kristian Finfrock engaged in negligence and fraudulently induced them to hold an investment. The investor is seeking $100,000; the dispute is pending.

Unsuitable Investment Allegations

There are two other disclosures that allege Kristian Finfrock made unsuitable investment recommendations.

In a disclosure dated May 24, 2021, an investor alleged that Kristian Finfrock alleged they concentrated the investor’s accounts, including IRA accounts, in illiquid, high-commission private placement investments. Private placements are always riskier because they do not have to disclose information about their financials.

On January 7, 2020, an investor alleged that Kristian Finfrock recommended unsuitable investments. The investor sought $500,000; the dispute settled for $100,000.

FINRA Rule 2111 requires brokers to evaluate whether an investment fits their investor’s financial goals. Brokers must examine the investor’s profile, which contains information about the following investor characteristics:

  • Age
  • Financial goals
  • Risk tolerance
  • Time horizon (i.e., how long the investor plans to hold the investment)
  • Investing experience

Your broker should understand your financial goals and adapt their investing strategy if your financial needs change. Brokers are also required to perform their due diligence to evaluate an investment and understand its potential to lose money. If you believe your broker recommended unsuitable investments, you should contact a securities lawyer.
