Investor Dispute

Suspension by FINRA

On December 9, 2016, Kevin Curry consented to the entry of findings that he allegedly exercised discretion in a client’s account without receiving proper authorization from the client or his firm, Petersen Investments.

A letter of Acceptance, Waiver & Consent (AWC) alleges that, between May 2011 and March 2014, Kevin Curry executed transactions in a client’s account without written authorization from the client or approval from the firm for the discretionary trading in the account.

The AWC alleges that Kevin Curry had spoken to his client about the investments and received approval for the trades, but that he exercised time and price discretion by conducting trades without discussing them with the client.

These allegations of unauthorized trading, according to the AWC, violate NASD Rule 2510(b) and FINRA Rule 2010.

FINRA Rules 3260 and 2010

FINRA Rule 3260 forbids unauthorized trading and requires brokers to receive written authorization from both their client and their firm before exercising discretion in a client’s account. 

FINRA Rule 2010 requires brokers to uphold high standards of professional honor and ethical conduct.

Sanctions

Kevin Curry consented to the following sanctions:

  • $5,000 fine
  • Suspension for 10 business days

His suspension began on January 3, 2017, and ended on January 17, 2017.

Settled Investor Dispute

Kevin Curry was also the subject of a dispute filed on June 4, 2014, alleging churning, unauthorized trading, fraud, and failure to supervise. The investor received a settlement of $285,000.
