FINRA Recommends Disciplinary Action Against Joseph Eisler

FINRA Investigation
On January 21, 2025, FINRA entered a preliminary determination to recommend disciplinary action against Joseph Eisler, alleging that he improperly shared in client profits and improperly disclosed the confidential trading strategies of a third-party fund manager.
FINRA further alleged that Joseph Eisler caused his firm to maintain incomplete books and records by using text messages for business communications.
FINRA Rule 2150
FINRA Rule 2150(c) prohibits brokers from directly or indirectly sharing in the profits or losses of a client’s account unless they have prior authorization from both the client and their firm.
Further, brokers can only share in the profits or losses of an account in direct proportion to their own financial contributions to it.

FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.

FINRA Rule 4511 requires firms to keep accurate and up-to-date books and records.
Resignation from Morgan Stanley Wealth Management
On December 19, 2022, Joseph Eisler resigned from Morgan Stanley Wealth Management following allegations that he made an agreement with a client to receive unapproved compensation in connection with trading opportunities, and that he shared confidential client trading information without authorization through an unapproved messaging platform.
Investor Dispute
On September 8, 2022, an investor alleged that Joseph Eisler made misrepresentations with regard to trading in their account between 2011 and 2022. This dispute was settled for $900,000.
