John Davis Embroiled in Investor Dispute for Allegedly Failing to Follow Instructions

John Davis (CRD #:2312724), a broker and investment advisor registered with Edward Jones, is involved in an investor dispute, according to his BrokerCheck record, accessed on January 19, 2022. 

According to the allegations filed on October 21, 2021, John Davis failed to follow his client’s instructions to liquidate her account. The client further alleged that John Davis misrepresented the potential tax implications of liquidating the account. The investor is seeking $300,000the case is still pending.  

What FINRA Rules did John Davis Allegedly Violate? 

FINRA Rule 2010 

It is the duty of a broker to perform a customer’s orders promptly in a manner best suited to serve the customer’s best interest. Failure to follow customer instructions, both as directed and promptly, violates FINRA Rule 2010, which requires all registered members to observe high standards of commercial honor and just principles in their business dealings.

FINRA Rule 2020

This unethical conduct also violates FINRA Rule 2010, which states that brokers must uphold high standards of commercial honor.  

Losses that can be attributed to a stockbroker’s material misrepresentations of facts may result in a securities arbitration claim for damages.
