FINRA Bar
On December 1, 2023, Joe Gainer consented to the sanction and the entry of findings that he refused to appear for on-the-record testimony by FINRA in connection to its investigation into an internal review by his firm. The investigation involved allegations that he failed to disclose a position of trust in relation to receiving a $3 million dollar gift.

High Standards of Commercial Honor
FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade. Failing to disclose a position of trust may violate this rule.
Investor Allegations
On September 23, 2020, an investor’s authorized representative alleged that an investment was overly aggressive for the client’s age. The investor sought $221,630.00 but the dispute was denied by the firm. Investors should know, however, that firms can deny disputes without an external review. Investors may be able to recover their losses after a denial by pursuing FINRA arbitration.
