This rule applies to investment recommendations, discretionary trades, and recommendations or execution of investment strategies. For example, a broker executing an excessive number of trades would be unsuitable because churning generates fees and commissions that cut into clients’ returns.

Investors who believe their losses are the result of unsuitable investment recommendations may be able to recover their funds through FINRA arbitration.
