Investor Dispute

On July 5, 2022, an investor alleged that Jason Bertram facilitated the rolling over of funds from a 401(k) and recommended the client use some of the funds to purchase a Northwestern Mutual fixed annuity in or around June 2019.

The client further alleged that Jason Bertram misrepresented the annuity contract options as being changeable after the contract was issued and failed to disclose how the annuity’s death benefit could be eliminated under certain conditions. The firm denied this dispute.

However, investors should know that firms can deny disputes without an outside review. Investors can still pursue FINRA arbitration after a denial and may be able to recoup their losses.

FINRA Rule 2020

FINRA Rule 2020 bans the use of manipulation, deception, and other fraudulent methods of influencing investors’ decisions. The misrepresentation of an investment’s features, requirements, or other relevant information violates this rule.
