FINRA Suspension

On October 14, 2024, Ivanhoe Ffriend consented to the entry of findings that he allegedly caused Cetera Advisor Networks to keep inaccurate books and records by mismarking order tickets for equity transactions as unsolicited instead of solicited.

According to a Letter of Acceptance, Waiver & Consent (AWC), between February 2019 and November 2021, Ivanhoe Ffriend allegedly mismarked 500 order tickets for equity transactions that he recommended to clients as being unsolicited trades. However, the AWC alleges that his recommendations of the transactions required them to be marked as solicited.

Further, the AWC alleges that Ivanhoe Ffriend executed trades in four client accounts without prior written authorization to do so. Cetera Advisor Networks had allegedly not accepted the accounts as discretionary.

The AWC concluded that these allegations constitute violations of FINRA Rules 4511, 2010, and 3260(b).

FINRA Rule 4511

FINRA Rule 4511 requires firms to keep accurate and up-to-date books and records.

FINRA Rule 2010

FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.

FINRA Rule 3260

FINRA Rule 3260 limits brokers trading discretion to pre-approved discretionary accounts. These accounts must be approved for discretionary trading by both the client and the firm.

Sanctions

Ivanhoe Ffriend consented to the following sanctions:

  • 3-month suspension from associating with FINRA members
  • $7,5000 fine

His suspension began on November 4, 2024, and will end on February 3, 2025. You can access the full AWC here.
