Henrique Lucena Has Entered Bankruptcy Following Dispute with Morgan Stanley

Investor Allegations

On April 1, 2025, an investor alleged that Henrique Lucena executed unauthorized trades and recommended unsuitable investments. The investor is seeking $1,000,000. 

On November 11, 2020, an investor alleged that Henrique Lucena misrepresented an investment and executed unauthorized trades. The dispute was settled for $350,000.

Unauthorized Trading

FINRA Rule 3260 requires brokers to receive written authorization from their clients before engaging in discretionary trading. Discretionary accounts must also be approved by the firm before this trading can occur.

What is an Unsuitable Investment? 

FINRA Rule 2111, a.k.a. The Suitability Rule, requires brokers to tailor their investment recommendations to suit investors’ needs. 

Rule 2111 also requires brokers to consider the following investor characteristics: 

  • Age
  • Risk tolerance
  • Time horizon (i.e., how long the investor plans to hold the investment)
  • Investing experience
  • Tax status
  • Financial goals

Investments that do not fit the criteria established by the investor profile may be unsuitable. Investors who rely on brokers for recommendations may recover their losses by pursuing FINRA arbitration.

Financial 

On July 16, 2021, Henrique Lucena filed for bankruptcy.

Regulatory Action

On March 5, 2021, FINRA alleged that Henrique Lucena failed to comply with an arbitration award. Henrique Lucena allegedly asserted he could not pay an arbitration award rendered in the matter of Morgan Stanley LLC vs. Henrique Lucena. The hearing was held on June 2, 2021, and the hearing officer determined that Lucena had failed to establish his defense. FINRA fined Henrique Lucena $1,631.88 and suspended him for six days.
