Gregg Ferguson Is Subject of a FINRA Investigation

Gregg Ferguson (CRD #: 4400990), a broker previously registered with LPL Financial  , is the subject of a FINRA investigation, according to his BrokerCheck record, accessed on December 14, 2021.  

Gregg Ferguson’s FINRA Case  

On November 22, 2021, FINRA announced that it was investigating Gregg Ferguson. The investigation stems from the following allegations: 

  1. Forgery Allegations 

According to the allegations, on December 31, 2019, Gregg Ferguson signed a customer’s name on two Required Minimum Distribution (“RMD”) forms in connection with distributions from the customer’s annuities without the customer’s knowledge or authorization. 

Falsification occurs when a person creates a document that purports to be something other than what it is by including altered or untrue information. Falsification is inconsistent with just and equitable principles of trade and violates FINRA Rule 2010. 

FINRA Rule 2010, requires member firms and their associated persons to “observe high standards of commercial honor and just and equitable principles of trade. 

2. Providing False And Misleading Statements To FINRA 

According to FINRA, on May 26, 2020, Gregg Ferguson allegedly provided false and misleading statements to FINRA in response to a March 12, 2020 request issued by FINRA pursuant to FINRA Rule 8210. Gregg Ferguson reportedly falsely stated that he “did not forge” the customer’s signature on the two RMD forms. Gregg Ferguson also falsely asserted that a colleague may have been the person who signed the customer’s name on the documents. 

FINRA Rule 8210 requires associated persons to provide documents, testimony, and written information regarding any matter involved in an examination or investigation. A registered representative who provides false or misleading information to FINRA violates FINRA Rules 8210 and 2010.
