On October 9, 2023, Merrill Lynch, Pierce, Fenner & Smith fired Gino Rahman following allegations that he engaged in an undisclosed outside business activity with a client and accessed a client account in violation of firm policy. The firm further alleged he failed to comply with firm policy concerning the appointment of a family member as a beneficiary on a client’s accounts and provided inaccurate information.
FINRA Rule 3270 – Outside Business and Selling Away
FINRA Rule 3270 requires brokers to inform their firm of any outside business activities or any investments sold away from the firm. The brokerage firm may prohibit the activity if the firm believes the proposed activity may compromise the broker’s duties. Firms may also require brokers to seek approval for any outside business.
