Eddie Suarez Embroiled in Investor Dispute Following Selling Away Allegations

Eddie Suarez (CRD #2938893), a broker registered with PFS Investments, is involved in a pending investor dispute according to his BrokerCheck record accessed on April 5, 2022. 

According to the allegations filed on February 9, 2022, Eddie Suarez recommended the purchase of real estate property from a third party in 2020.

What is Selling Away?

When brokers recommend investments that are not offered by their registered member firm, they are engaging in a type of financial misconduct called “selling away“—a.k.a. unapproved securities transactions. FINRA prohibits selling away because it allows brokers to sell risky investments without supervision from their firm.

FINRA Rule 3270 prohibits brokers from participating in outside businesses without first providing written notice to their firm. After receiving that notice, the member firm may approve or disapprove the transaction. 

A violation of FINRA Rule 3280 is also a violation of FINRA Rule 2010, which requires brokers to observe high standards of commercial honor and just and equitable principles of trade in the conduct of their business.ss.
