On October 13, 2021, Fidelity Brokerage Services fired Drake Uplinger after he allegedly failed to provide accurate information on an employment application.
Drake Uplinger Allegedly Violated FINRA Rules 4511 and 2010
FINRA Rule 4511 requires each member to make and preserve books and records in conformity with Section 17(a) of the Exchange Act and Exchange Act Rule 17a-3. Inherent in the obligation to maintain books and records is the requirement that they must be accurate.
Failing to keep or preserve records accurately violates this rule and constitutes a violation of FINRA Rule 2010, which requires that members and their associated persons “observe high standards of commercial honor and just and equitable principles of trade.”
Falsifying documents is inconsistent with just and equitable principles of trade and also violates FINRA Rule 2010.
Termination at The Huntington Investment Company
On March 5, 2021, The Huntington Investment Company fired Drake Uplinger after allegedly failing to disclose three outside business activities, two of which were investment-related.
Undisclosed Outside Business Activities Violates FINRA Rules 3270 and 2010
FINRA Rule 3270 requires that brokers provide written notice to their firms regarding their outside business activities. By engaging in an outside business activity without providing prior written notice to his firm, Drake Uplinger allegedly violated FINRA Rules 3270 and 2010.
A violation of FINRA Rule 3270 also constitutes a violation of FINRA Rule 2010, which requires registered representatives to observe high standards of commercial honor and just and equitable principles of trade.
