In a dispute filed on February 2, 2022, investors allege that, between September 2020 and January 2021, Dennis Oleszkowicz was instructed by a successor trustee to move certain funds from inherited accounts into an inherited IRA but instead moved them into a regular investment account.
The clients allege Dennis Oleszkowicz committed negligence, misrepresentation, and made unsuitable investment recommendations, as well as violating Regulation Best Interest and the Michigan Uniform Securities Act MCL 451.2509.
Clients also claim they suffered $200,000 in damages due to the lack of tax deferment on these funds and lack of documentation consistent with their intended transfer to the inherited IRA. The dispute is currently pending.
On November 25, 2020, an attorney representing a trustee alleged Dennis Oleszkowicz and a certified senior advisor at UBS Financial Services failed to transfer an IRA account to an inherited IRA, and that this would cause errors in their tax reporting at the end of that year. The client sought $1,803,717 in damages but the dispute was denied.
