FINRA Bars Daniel Kiely For Alleged Refusal to Provide Testimony

On January 26, 2023, Daniel Kiely consented to the entry of findings that he allegedly refused to appear for on-the-record testimony requested by FINRA in connection with an investigation into his termination from Vanguard Marketing Corporation.
According to a Letter of Acceptance, Waiver & Consent (AWC), Vanguard Marketing Corporation filed a Uniform Termination Notice for Securities Industry Registration (Form U5) alleging that Daniel Kiely was terminated for a failure to obtain a certain license.
On December 6, 2022, FINRA allegedly requested Daniel Kiely’s testimony. He allegedly stated his refusal to appear for testimony on December 19, 2022.
The AWC concluded that this alleged refusal constituted a violation of FINRA Rules 8210 and 2010.

FINRA Rule 8210 requires members to submit their books and records for inspection and to appear for testimony in connection with FINRA investigations.

Sanctions
Daniel Kiely was permanently barred by FINRA starting on January 26, 2023.
