On June 8, 2022, FINRA entered a preliminary determination recommending that Christopher Polinaire face disciplinary action for allegedly executing excessive and unsuitable trades in investors’ accounts, violating FINRA Rules 2111 and 2010.

FINRA Rule 2111 requires brokers to tailor their recommendations of securities to fit investors’ profiles. These include information about an investor’s risk tolerance, tax status, and investment goals.

Excessive trading, also called churning, violates the requirement for quantitative suitability. In other words, the overall number of trades executed in an account must also be suitable for an investor’s goals.
