  1. Client Communication. He allegedly used an unapproved email address to communicate with clients. Under FINRA Rule 3110, brokers can only communicate with investors using channels that the firm can supervise.
  2.  Use of Discretion. FINRA Rule 3260 prohibits unauthorized trading. Brokers must receive customer authorization before executing a trade unless they are trading in a discretionary account. Discretionary accounts must be approved by both the firm and the investor.
  3. Failure to Timely Forward a Client Complaint. Brokers are required to report any investor complaints to their firm in a timely manner.
