FINRA Bars Bob Koestler For Alleged Refusal to Provide Testimony

On November 29, 2022, Bob Koestler consented to the entry of findings that he allegedly refused to appear for on-the-record testimony requested by FINRA.
According to a Letter of Acceptance, Waiver & Consent (AWC), LPL Financial filed an amended Uniform Termination Notice for Securities Industry Registration (Form U5) disclosing that it had conducted an internal review into Bob Koestler’s alleged involvement in potentially unauthorized trading and the marking of solicited trades as unsolicited.
The AWC alleged Bob Koestler informed FINRA of his refusal to appear for on-the-record testimony on October 18, 2022.
The AWC concluded that this alleged refusal violated FINRA Rules 8210 and 2010.

FINRA Rule 8210 requires members to submit their books and records for inspection and to appear for testimony in connection with FINRA investigations.

FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.
Sanctions
Bob Koestler was indefinitely barred by FINRA starting on November 29, 2022.
