Investor Dispute
On January 14, 2025, an investor filed a dispute alleging that Vipul Talati made a recommendation that did not align with their investment objective of capital preservation. This recommendation allegedly led to unrealized loss in market value between September 17, 2024, and the date of dispute filing.
This dispute was denied by the firm. However, investors should be aware that firms can deny disputes without allowing an outside review. You can still pursue FINRA arbitration after a denial and may be able to recover your losses.
FINRA Rule 2111
FINRA Rule 2111 requires brokers to take investors’ profiles into account when recommending investments. These profiles describe an investor’s age, investing experience, tax status, risk tolerance, and other characteristics.
This rule also extends to the overall investment strategy a broker recommends. For instance, an investment strategy might be unsuitable if the securities are overconcentrated in a particular stock or sector.
Investors who rely on brokers for recommendations may be able to recover their losses by seeking out FINRA arbitration.
