Suspension by FINRA
On August 29, 2022, Simon Granner consented to the entry of findings that he allegedly failed to disclose an outside business activity fully and in a timely manner to his firm, Thrivent Investment Management.
A Letter of Acceptance, Waiver & Consent (AWC) alleges that Simon Granner failed to provide prior written notice to his firm before forming a consulting services company in January 2020, in violation of the firm’s written supervisory procedures. He allegedly sought approval in February but failed to disclose that he would be providing financial sales coaching and training to people registered with Thrivent Investment Management.
The AWC alleges that Simon Granner knew or should have known the firm would deny him approval, as the firm had allegedly previously denied a request for approval he made for a “substantially similar” outside business activity in 2019.
In his consulting business, Simon Granner allegedly solicited 186 firm-registered persons to become coaching clients, nine of which became clients and paid him approximately $28,000. Simon Granner allegedly also falsely attested in an annual compliance questionnaire that he had disclosed his outside business activities fully and accurately.
The AWC concludes that these alleged actions constitute violations of FINRA Rules 3270 and 2010.
FINRA Rules 3270 and 2010
FINRA Rule 3270 requires brokers to inform their firm and receive approval for any business activities they engage in beyond their firm.
FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.
Sanctions
Simon Granner consented to the following sanctions:
- $5,000 fine
- 3-month suspension
His suspension began on September 6, 2022, and will end on December 5, 2022.
