FINRA Bars Patrick English Following Alleged Failure to Provide Testimony

Patrick English (CRD #: 5189025), a broker formerly registered with Comerica Securities, has been barred by FINRA, according to his BrokerCheck record, accessed on October 22, 2022. If you want to know more about Patrick English’s conduct as a broker, read on.

On August 12, 2022, Patrick English consented to the entry of findings that he allegedly refused to appear for on-the-record testimony requested by FINRA as part of an investigation into his resignation from Comerica Securities in 2021.

According to a Letter of Acceptance, Waiver & Consent (AWC), Comerica Securities filed a Uniform Termination Notice for Securities Industry Registration (Form U5) allegedly disclosing that the firm permitted Patrick English to resign due to the following allegations:

  • Violations of firm policies and procedures involving the use of text messages for exchanging trading directions
  • Improper use of discretion in client accounts
  • False reports made to clients that unplaced trades had been executed

The AWC alleged that Patrick English initially cooperated with FINRA’s requests, providing documents and information in November 2021, but ceased cooperating in July 2022. On July 19, 2022, his counsel allegedly stated his refusal to appear for testimony.

The AWC concluded that this alleged refusal to appear for testimony violated FINRA Rules 8210 and 2010.

FINRA Rule 8210 requires members to supply records, information, and testimony upon request by FINRA.

FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.

Sanctions

FINRA permanently barred Patrick English on August 12, 2022.

Resignation from Comerica Securities

On February 9, 2021, Patrick English was permitted to resign from Comerica Securities following allegations that he represented to clients that their instructed transactions were executed when he had instead failed to place the transactions.
