Kevin Casey Suspended by FINRA

Kevin Casey (CRD #: 2294037), a broker registered with Janney Montgomery Scott, was recently suspended by FINRA, according to his BrokerCheck record, accessed on April 18, 2023. Read on if you want to know more about his alleged conduct as a broker.

FINRA Suspension

On March 8, 2023, Kevin Casey consented to the entry of findings that he allegedly created and signed certain documents requested by FINRA after receiving FINRA’s request.

According to a Letter of Acceptance, Waiver & Consent (AWC), Janney Montgomery Scott allegedly used two surveillance reports to supervise its compliance with FINRA Rule 5131(d)(4). Kevin Casey was allegedly the firm’s supervisory delegate responsible for conducting daily reviews of these reports and documenting them on a checklist.

In September 2019, FINRA allegedly requested checklists from the firm for the period of April through June 2019. The AWC alleges that Kevin Casey had not created checklists for this period, and instead created and signed 12 checklists in October 2019 after the firm provided him with FINRA’s request. He allegedly also did not disclose these facts to FINRA.

The AWC concludes that this alleged misconduct constitutes a violation of FINRA Rule 2010.

FINRA Rule 5131

FINRA Rule 5131(d)(4) prohibits firms from accepting market orders of shares of a new issue in the secondary market before trading has begun in that market.

FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.

Sanctions

Kevin Casey consented to the following sanctions:

  • $5,000 fine
  • 30 calendar-day suspension

His suspension began on April 3, 2023, and will end on May 2, 2023.
