Investors Allege Jason Holowinski Recommended Unsuitable and Aggressive Investments

Jason Holowinski (CRD #: 2390903), a broker registered with Janney Montgomery Scott, allegedly made unsuitable investment recommendations, according to his BrokerCheck record, accessed on April 25, 2023. Keep reading if you want to know more about his alleged conduct as a broker.

Investor Disputes

Five disputes filed in February and March 2023 alleged that Jason Holowinski recommended unsuitable investments. Investors alleged that these recommendations occurred during a collective time frame spanning December 2015 to December 2022. Investors sought over $1.2 million, but the firm denied all of the disputes. 

Investors should be aware, however, that firms don’t need to allow an external review before denying disputes. Investors can still seek out FINRA arbitration and may be able to recover their losses following a denial.

One dispute, dated March 3, 2023, alleged that Jason Holowisnki purchased unsuitable investments and executed trades against the client’s specific instructions from December 2015 to December 2022. The client sought $604,277 in damages in this denied dispute.

FINRA Rule 2111

FINRA Rule 2111 requires brokers to tailor their investment recommendations to suit investors’ profiles. These profiles contain information about investors’ risk tolerance, tax status, and investment goals.

Investment strategies must also serve investors’ goals. Overconcentration in a particular sector or stock is often an unsuitable investment strategy, due to the high degree of risk.

Investors who rely on brokers for investment recommendations can pursue FINRA arbitration and potentially recover their losses.

FINRA Rule 5310

FINRA Rule 5310 requires brokers to execute clients’ transactions according to their instructions.
