On August 20, 2024, Puerto Rico alleged that James Colleary had failed to uphold his supervisory duties as a supervisor with Nationwide Planning Associates. The regulator alleges that he failed to reasonably supervise an agent and that failure allegedly allowed the agent to cause serious harm to multiple investors by violating the Puerto Rico Uniform Securities Act and recommending unsuitable investments.
Puerto Rico further alleged that the agent engaged in the switching of mutual funds and Unit Investment Trusts (UITs), unauthorized trading, and misrepresentation.
