Haiguang Yin Allegedly Recommended Unsuitable Investments

On March 5, 2025, multiple investors filed a dispute alleging that Haiguang Yin made unsuitable investment recommendations. This dispute is pending.
On April 16, 2024, investors alleged that Haiguang Yin recommended an unsuitable investment which resulted in losses. The investor further alleged he misrepresented the risks and breached his fiduciary duty. The investor is seeking $500,000.
What is an Unsuitable Investment?
FINRA Rule 2111 requires brokers to evaluate whether an investment strategy fits their investor’s financial goals. Brokers must examine the investor’s profile, which contains the following investor characteristics:
- Age
- Risk tolerance
- Time horizon (i.e., how long the investor plans to hold the investment)
- Investing experience
- Tax status
- Financial goals
Investors who rely on brokers for recommendations may be able to recover losses from unsuitable investment recommendations by pursuing FINRA arbitration.
Misrepresentation
FINRA Rule 2020 forbids the use of deceptive, manipulative, and otherwise fraudulent methods to influence the purchase and sale of securities. Misrepresenting an investment’s risks, fees, limitations, or other features violates this rule.
Fiduciary Duties
A fiduciary duty is a duty to work in a client’s best interest. Brokers are not fiduciaries, but they must follow the rules set forth by FINRA Rule 2111 and Regulation Best Interest.
