Investors Allege Francis Amsler Misrepresented Options Overlay Strategy

Investor Disputes
On July 21, 2022, an investor filed a dispute alleging that Francis Amsler made misrepresentations regarding recommendations to invest in and hold an options overlay strategy between 2017 and May 2019 and that these recommendations were unsuitable. This dispute is pending.
Francis Amsler was also named in seven other investor disputes filed in 2020-2021 making similar allegations. These disputes alleged a collective timeframe of misconduct ranging from 2016-2019 and were settled for a total of approximately $8,331,222.33.
A dispute filed on November 4, 2020, alleged that Francis Amsler pitched an unsuitable options overlay strategy that featured a conflict of interest. He also allegedly failed to disclose the risks associated with the strategy. These violations allegedly occurred between August 1, 2016, and June 20, 2019. The client sought $1,775,430.13 in damages but was denied by the firm.
Another dispute, filed on April 7, 2020, alleged that Francis Amsler and others invested the client’s money in a “super high risk” strategy and failed to disclose certain risks. This dispute was also denied by the firm.
Investors should know, however, that firms don’t need to allow an outside review before denying disputes. Investors can still seek out FINRA arbitration following a denial and may be able to recover their losses.

FINRA Rule 2111 requires brokers to tailor their investment recommendations to suit investors’ profiles. An investor’s profile contains information about their risk tolerance, age, and financial goals.
Investors who rely on brokers for recommendations may be able to recover their losses by pursuing FINRA arbitration.
